|| In moving to dismiss on the grounds of discriminatory prosecution let me start by saying
I really am a concern to the United States government since I discovered hard evidence
that proves, not only that Time, Newsweek and U.S. News are used by the government to
document secrets, via bold print cryptography surrounding the night of John Lennon's murder,
including the killer's alleged name and attached letter weeks before the crime, the facts
prove that Richard Nixon and Ronald Reagan arranged for horror writer, Stephen King, to
actually kill Lennon while look-alike, Chapman, was only a ruse to mislead the public, the
entire mass media in tow. The courts, in tow.
I believe that a pattern of fraud and abuse by the San Francisco police department during
mostly the late 80's and the 90's to suppress my activism then suggests that the same kind
of abuse is being orchestrated against me, now, either to suspend my licence to get my
newly re-sloganed van off the streets, or to establish a record of my recklessness, via
orchestrated tickets, to then kill me, later, and then point to the tickets as the reason
I wound up dead in a traffic accident. That I was the cause of any upcomming accident.
Already I have been kidnapped and pistolwhipped, uncounscious, while handcuffed, in the
back of a San Francisco police van in 1987 at the hands of officer's Kevin Hall and Steven
Rist. No attorney would help me in my efforts to sue the city. The police review board
failed to address the issue, as well. I have had police point guns in my face three times,
once within hours of Reagan's re-election and, amidst a flurry of other police abuses
against me, my father was killed in a small plane crash weeks after his dog was found
strangled in the drape cord and just weeks after I received a threat letter from, apparently,
In 1996, when I vivited Palm Springs, Ca., I encountered four false citations and one illegal
tow of my vehicle, not because I committed any violation (All four tickets were eventually
dismissed), but because, unbeknownst to me, Stephen King lived there, then. It was pure
political harrassment and included one gun pointing episode and one attempt by their
police to beat me up except that I had witnesses to discourage them.
In 1992, the first day I visited Bangor, Maine, King's home town, I was issued a false cita-
tion and encountered police six times and even had my tape recorder and car keys stolen
from my van while making a phone call. Weeks later I received another false ticket and,
after having to stay there for several months, finally had both tickets dismissed.
In the San Francisco bay area I received 100 false parking tickets in three years and beat
almost all of them though the courts had me running back and forth like a yo yo to fight
them all. During the same time frame I was a victim of several false arrests, all dismissed,
and was assaulted by two strangers who told me, simply; "we don't need the publicity."
before they dislocated my shoulder and smashed my face into a sidewalk breaking my nose.
Then D.A. Costello released the suspect without charges after I had him arrested. It was
a few months later that S.F.P.D. literally kidnapped and pistolwhipped me unconscious in
the back of their van while I was handcuffed. Officers Kevin Hall and Steven Rist were
never held to account for their crime against me. I had done nothing to merit anything and
their police report was a fabrication of utter, outright lies.
I am not imagining paranoid conspiracies when I say that the government may have already
tried to kill me in 2007 in a red light intersection where a woman ran a red light and
t-boned my delivery truck at over 55 mph. I would later learn that the city of Concord,
Ca. has remote control capabilities with their lights and can be controlled and monitered
from a room in a building by an employee.
I believe that Stephen King, himself, may have been targeted for assassination in 1999
when he was mowed down by a van in Maine. The government wants my story to go away.
Except for this spate of tickets, suddenly, I have not had a ticket in almost ten years,
the only exception being one in Portland, Maine that was an overt political assault.
That ticket was issued illegitimately and blatantly discriminatorilly, when, just hours
after the Portland, Maine police interrogated me while sleeping in my van the night I ar-
rived in King's town of birth, I was falsely pulled over for a charge I never committed.
When the judge ruled with me on the charge on the citation he, then, allowed a new, false
allegation, not on the citation, to stand even though it was also false. That was in 2008.
Except for that unjust, politically motivated ticket I have not had a valid ticket in almost
ten years. This though I drive an average of 30 thousand miles per year.
Now, suddenly, and just months after Jerry Brown became governor, I have received four
seperate tickets, all at once, in a few short months and, already, one was dismissed because
the film showed me making a full and complete stop before making a right turn and the offic-
er agreed and dismissed it before it went to court, but only at the last minute after weeks
of delay. Sergeant Eastman, three times, failed to follow through with his promise to pull
my ticket out of the cue until I notified his secretary I might have to subpeona him to
Los Angeles in another matter to show conspiracy. It was dismissed, barely in time, though.
None of these tickets were valid and the fact that two of them were red light camera tick-
ets rings huge alarm bells where I am concerned as the plot to set the stage for another
attempt to kill me in traffic looms obvious. The government may be trying to fabricate evi-
dence to suggest I am a careless, reckless driver before I am actually killed, later,
in a traffic accident, likely at a red light or, perhaps, a head on collision with a large truck.
This sudden spate of tickets began in April of 2011 in San Francisco;
The episode began when I noticed a police officer involuntarilly rev his accelerator in a
parking lot at the sight of me entering. A familiar sight there with my websight emblazened
van I wondered what was different, what was going on with me that he may have known about.
I took a long nap and, after awaking, decided to cross town at 3:00 am to avoid traffic.
I was in no hurry and it was misty and I had only traveled about a mile from the lot.
I was trapped in a series of consecutive yellow to red light stops at 3:25 am, three in a row,
when the other driver next to me and I looked at each other as if to say; "What's going on
with these lights!?" When the light turned green we both, naturally, tried to get up to
speed quickly to escape the situation. Yet the fourth light in a row went yellow at the
last moment and I did just make it, according to the photo. (My van has an extremely long
nose from the front axel that proves a flaw in their system of road sensors.) I just made
it and had no safe choice except to continue forward as there was a speeding motorist right
behind me and I would have likely caused an accident had I tried to stop suddenly. Besides,
there were no other cars on the road anywhere. The yellow light was abbreviated as well.
That the three previous lights, literally, put me and the other driver into a "cue" to
"enhance" the likelyhood of a violation seems suspicious and out of character for those
lights in years of memory driving there.
Just weeks later I received a notice in the mail of yet another red light camera ticket
just a few miles away from the first site. That was reveiled as an attempt to pull me into
violation when the film showed I was not. It was the one Sergeant Eastman dismissed.
A few weeks later I was pulled over by a Berkeley, Ca. motorcycle officer who was not a
witness to the charge he cited - making an unsafe turn from the center lane - In fact,
a woman in the number two lane saw that I was trying to merge right and she stopped and
waved me ahead of her. I saw the stopped officer at the intersection and was hoping
he would look up to see what was happening but he was preoccupied with something on his
handlebars or gloves as I made my maneuver. Just as I completed my right turn he looked
up and judged that I had illegally turned from the number one lane to turn right. In
fact I made a legal turn but he didn't see what happened. What strikes me about this
ticket was that it was just blocks away from the NoLo Press bookstore that carries books
on how to fight your ticket in court that I was visiting just a minute earlier.
Finally, just weeks after moving to Los Angeles and after a driving pattern could be
established with my new delivery job, I was putting gas in my truck and making a phone
call to my storage facilty up north. I wrote their address on my gas receipt, ended the
call and buckeled up and drove out of the station. Immediately I noticed that my phone
cord was tangled in my seatbelt and restricting my movement. At the very first light, a few
blocks from the gas station, while fully stopped, I momentarilly unbuckeled my seatbelt
and untangled my phone cord from it and was about to buckel up again when I looked up to
see an officer standing in the street directly in front of my truck demanding me to stop.
When I told him to look at my phone log to prove I had not been on the phone as he claimed
he refused to look. When I told him I was just at a gas station a minute earler and tried
to show him my receipt he refused to look as well. He ignored the facts and cited me.
All this ticket activity in just a few months time and after ten years of ticket free
driving. The way the courts are handling the situation raise more red flags;
Two seperate courts, one in San Francisco and one in Van Nuys, both had me scheduled to
appear on September 26, 2011, as I recall, before I requested an extension.
Regarding the matter pending in San Francisco three seperate entities all claimed they had not
received my motions that I mailed in October and, after I mailed second copies, refused to
let me know if my extension was granted until the last minute after I was already 50 miles
from L.A. driving north, renminiscent of the other situation that rode down to the last
minute. This in spite of days of effort on my part and dozons of calls to find out.
I have to suggest that all these tickets are the result of fraud and discrimination and
that a more sinister picture is being painted by the government to suggest that I am reck-
less and to blame for any future accident they may have planned for me.
I cannot let even one of these tickets slip through and ask you to admit that there is a
reasonable doubt as to whether these tickets are just coincidence or conspiracy.
I have not only been wrongly arrested a dozon times and cited dozons of times and beaten
by strangers over my Lennon murder expose activism I have been featured, in a false, light,
on major television news and even the show American Journal. In my 57 years on earth I
have a clean record, in spite of all those arrests and abuses.
I feel Jerry Brown is behind all this and that our government is behind his attempts to tar
me with this spate of false tickets. I have a reasonable fear that my life is in danger,
especially if any of these tickets stick. I am afraid that my last red light accident was
no accident, either. I don't want you to let anyone cast me in a reckless light.
That all this could be just a hyped up effort by enforcement to enhance revenue for the state
is possible but I fear it's more than just that.
I am a very safe driver with a record and many thousands of miles to prove it. These
tickets and this ticket are the work of the same government that has abused me for decades.
When I was subjected to the three consecutive last second yellow light stops that occured
just before this camera intersection I remember thinking, as the light went from yellow
to flash, no red inbetween, in the fourth intersection, I remeber thinking, then, that I
was, not only completely set up and sheperded into a cue to maximize a chance for a vio-
lation at that light, but also how similar it felt to the surprise accident I suffered
in 2007 when the woman who DID run a red light was never cited for it. As if it was all
part of a plan, thought out beforehand, to make me look responsible when I was not.
More probably, that it was an attempt to kill me, possibly by rigging the lights.
The other subsequent tickets that occured right after only reinforced that suspicion and,
indeed, has opened up a whole episode of post traumatic stress symptoms resulting from
going over the former decades old abuses from the past. The day after typing up my first
draft of this motion I awoke with a very sore right hand and pinky, as if I had lashed
out at some imaginary enemy in a nightmare and struck my hand on something. In 57 years
that has never happened before. Subsequently I've had to seek employment elsewhere as I
suddenly could not sell even a third of what I was used to I was so distracted and terrorized.
Currently I have had to take a leave of absense from my third job since this ticket because
my expenses are more than my income and I have been making a negative income. I am sure
this has to do with how upset this spate of tickets has left me and because I am afraid
that the government is either plotting to suspend my licence to get my van off the streets
or is, in fact, plotting to assassinate me via a traffic accident.
I would not be this upset if I wasn't sure that I am being witch-hunted and that this
ticket was the first assault on my life and peace of mind. I am convinced that the govern-
ment may also be trying to provoke me to commit a crime of retaliation to then lock me up
for whatever they hope I might do. That my enemies are trying to criminalize me that way
as well. I have had my nerves run ragged lately and my instincts tell me that I am am
not paranoid at all but have really been attacked by the government via tickets I did not
If I had a jury of my peers and could present all this before the court I can't see how
they could dismiss the possibility that this ticket was part of a vindictive campaign
against my activism which threatens, not only the reputation of San Francisco and its
police department from its' past, but threatens to destroy the reputation of two presidents and
may even undo such institutions as Time, Newsweek and U.S. News magazines. I have big-
ger enemies than the mafia and I argue that there is far too much doubt about this matter to
find me guilty of running a red light at 3:25 am with a speeding motorist right behind me,
the two of us trying to escape a series of frustrating last second stops, and with my
licence plate actually over the line or too close tell from the angle of the camera, my
unusually long nose to front axel ratio negating the normal measurement for guilt that
rely on sensors that react to tire pressure. My van has at least two feet more nose than
most cars and that argument can't reliably be used against me.
There is reasonable doubt as to whether or not this ticket was coincidence or conspiracy.
